Terms and Conditions of Service

What are Fair Fix Garage Doors' terms and conditions?

By using Fair Fix Garage Doors' services, you agree to: upfront pricing with no hidden fees, 90-day labor warranty, payment due upon completion, liability protection for technicians, and binding arbitration in Utah County. Utah law governs all agreements. Effective January 5, 2026.

These terms apply to all Fair Fix Garage Doors services performed in Utah, including emergency repairs, installations, and maintenance.

These Terms and Conditions ("Terms," "Agreement") govern your use of services provided by Fair Fix Garage Doors ("Company," "we," "us," "our"). By scheduling service, allowing our technicians on your property, or using our website, you ("Customer," "you," "your") agree to be bound by these Terms.

PLEASE READ THESE TERMS CAREFULLY. BY USING OUR SERVICES, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE OUR SERVICES.

1. Services Provided

Fair Fix Garage Doors provides the following services throughout Utah:

  • Garage Door Repair: Spring replacement, opener repair, cable/roller repair, track alignment, panel replacement, sensor repair
  • Garage Door Installation: New residential and commercial garage door installation
  • Garage Door Maintenance: Tune-ups, lubrication, safety inspections
  • Emergency Services: 24/7 emergency repair for safety hazards (stuck doors, broken springs, malfunctioning safety features)

Service Area: We primarily serve Salt Lake County, Utah County, and surrounding areas. Service availability outside these areas is determined on a case-by-case basis. Travel fees may apply to locations beyond our standard service area.

2. Pricing and Payment

2.1 Pricing

  • Upfront Pricing: We provide a written estimate before starting work (except diagnostic fees)
  • Diagnostic Fee: $75 service call fee, waived if you proceed with recommended repairs over $150
  • Pricing Changes: If additional work is discovered during service, we will notify you and obtain approval before proceeding
  • No Hidden Fees: All prices include parts, labor, and disposal of old materials unless otherwise specified

2.2 Payment Terms

  • Payment Due: Payment is due upon completion of service
  • Accepted Methods: Cash, credit/debit cards (Visa, Mastercard, Amex, Discover), checks
  • Credit Card Processing: We use secure third-party processors (Stripe, Square)
  • Returned Checks: $35 fee for returned checks, plus any bank fees
  • Late Payments: Unpaid invoices over 30 days may incur 1.5% monthly interest (18% APR) and collection fees

2.3 Refunds

Service Refunds: If you are unsatisfied with our work, contact us within 7 days. We will inspect the work and, at our discretion, offer to re-perform the service, provide a partial refund, or issue a full refund. Refunds are not available for:

  • Diagnostic fees (if you decline repairs)
  • Parts that have been installed and used
  • Damage caused by customer misuse or third-party modifications

3. Warranties

3.1 Labor Warranty

90-Day Labor Warranty: We warrant our workmanship for 90 days from the date of service. If the same issue recurs due to our faulty installation or workmanship, we will re-perform the work at no charge.

Labor Warranty Exclusions:

  • Damage caused by customer misuse, abuse, or neglect
  • Damage from extreme weather events (tornadoes, floods, earthquakes)
  • Modifications or repairs performed by third parties after our service
  • Normal wear and tear on components

3.2 Parts Warranty

Parts are warranted according to the manufacturer's warranty:

  • Garage Door Springs: Typically 1-3 years (varies by manufacturer and spring type)
  • Garage Door Openers: Typically 1-5 years manufacturer warranty
  • Cables, Rollers, Hinges: Typically 1-2 years
  • Garage Doors: Manufacturer warranty (varies by brand, typically 1-10 years)

We will provide warranty documentation at the time of service. To make a warranty claim, contact us at (385) 484-8951 with proof of service (invoice).

3.3 Warranty Disclaimer

EXCEPT AS EXPRESSLY STATED ABOVE, WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. SOME STATES DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

4. Customer Responsibilities

By using our services, you agree to:

  • Provide Accurate Information: Give correct contact information, service address, and description of the problem
  • Property Access: Ensure our technicians can safely access the work area (clear garage of obstructions, restrain pets, etc.)
  • Legal Authority: Confirm you are the property owner or have authority to authorize repairs (landlord permission for rentals)
  • Safety Compliance: Follow all safety instructions provided by our technicians (e.g., do not operate door during repair)
  • Maintenance: Perform basic maintenance as recommended (lubrication, visual inspections) to prevent premature wear
  • Timely Payment: Pay invoices by the due date

5. Limitation of Liability

5.1 Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SPECIFIC SERVICE THAT GAVE RISE TO THE CLAIM.

5.2 Exclusion of Consequential Damages

WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

  • Lost profits or business interruption
  • Vehicle damage due to inability to use garage
  • Property damage from weather exposure (frozen pipes, water damage from open garage)
  • Personal injury not directly caused by our negligence

5.3 Insurance

Fair Fix Garage Doors carries general liability insurance and workers' compensation insurance. We are not responsible for damage caused by:

  • Pre-existing conditions not disclosed before service
  • Acts of God (earthquakes, floods, tornadoes, lightning strikes)
  • Customer negligence or failure to follow instructions
  • Third-party modifications after our service

6. Scheduling and Cancellations

6.1 Appointment Scheduling

  • Appointments are scheduled via phone (385) 484-8951 or online contact form
  • We provide arrival windows (e.g., 9am-12pm) and call 30 minutes before arrival
  • Emergency services are prioritized and may delay scheduled appointments

6.2 Customer Cancellations

  • No-Show Fee: If you are not available during your scheduled appointment window without 24-hour notice, a $75 no-show fee applies
  • Cancellation Policy: Cancel or reschedule at least 24 hours in advance to avoid fees
  • Work-in-Progress Cancellation: If you cancel after work has started, you are responsible for payment for work completed and parts ordered

6.3 Company Cancellations

We reserve the right to cancel or reschedule appointments due to:

  • Severe weather or unsafe working conditions
  • Technician illness or emergency
  • Parts unavailability (we will notify you immediately and offer alternatives)

7. Property Access and Safety

7.1 Safe Working Conditions

You agree to provide:

  • Clear access to the garage door and opener
  • Secure pets in a separate area during service
  • Remove vehicles and obstructions from the work area
  • Disclose any known hazards (asbestos, lead paint, structural damage)

7.2 Right to Refuse Service

We reserve the right to refuse service if:

  • Working conditions are unsafe (structural instability, aggressive pets, hazardous materials)
  • Customer is intoxicated, abusive, or threatening toward technicians
  • Required permits are not obtained (for new installations requiring permits)
  • Property access is denied or restricted

If we refuse service due to unsafe conditions, the diagnostic fee ($75) still applies.

8. Dispute Resolution and Arbitration

8.1 Informal Resolution

If you have a dispute with Fair Fix Garage Doors, please contact us first at (385) 484-8951 or frank@fairfixgaragedoors.com. We commit to resolving disputes amicably within 30 days.

8.2 Binding Arbitration

If informal resolution fails, you agree to binding arbitration instead of court litigation, EXCEPT for small claims court actions under $10,000.

Arbitration Terms:

  • Arbitration Organization: American Arbitration Association (AAA) under its Commercial Arbitration Rules
  • Location: Utah County, Utah
  • Costs: Each party pays their own attorney fees unless the arbitrator awards fees to the prevailing party
  • No Class Actions: Arbitration is conducted on an individual basis only; no class action or representative arbitrations

8.3 Opt-Out of Arbitration

You may opt-out of arbitration by sending written notice to Fair Fix Garage Doors, Cedar Hollow Blvd, Lehi, UT 84043, within 30 days of your first use of our services. If you opt-out, disputes will be resolved in Utah County courts.

9. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to conflict of law principles. Any legal action arising from these Terms or our services must be brought in Utah County, Utah.

10. Intellectual Property

All content on our website, marketing materials, and documentation (logos, trademarks, text, images, videos) are the property of Fair Fix Garage Doors or our licensors. You may not use our intellectual property without written permission.

Customer Photos/Testimonials: By providing photos, reviews, or testimonials, you grant us a perpetual, royalty-free license to use them in our marketing materials (website, social media, advertisements). We will not use your full name or address without permission.

11. Termination

Either party may terminate the service agreement before work begins without penalty (subject to diagnostic fees and cancellation policies). Once work has started, you are responsible for payment for work completed and parts ordered.

We may terminate our relationship with you if you:

  • Fail to pay invoices after 60 days
  • Engage in abusive or threatening behavior toward our staff
  • Provide false information or commit fraud

12. Changes to These Terms

We may update these Terms from time to time. The updated Terms will be posted on our website with a new "Last Updated" date. Continued use of our services after changes constitutes acceptance of the new Terms.

Material Changes: For significant changes (e.g., arbitration clause modifications), we will notify you via email or prominent website notice at least 30 days before the effective date.
